Terms of Service

Proximity is a technology platform that helps independent hosts discover guests and sell tickets to their own parties and events. Proximity is not the organizer, promoter, owner, or operator of any event, and is not a party to any agreement between a host and a guest. Hosts are solely responsible for their events, venues, conduct, and compliance with all laws.

You must be at least 18 years old (or the age of majority where you live) to create an account or host an event, and you must meet any age requirement an event sets. You are responsible for your account, your credentials, and all activity under your account. Provide accurate information and keep it current.

Attending in-person gatherings carries inherent risks, including risks of personal injury, illness, property loss, or harm caused by other attendees or third parties. You attend any event at your own risk. To the fullest extent permitted by law, you release and hold harmless Proximity from any and all claims, damages, or losses arising out of or related to any event, venue, host, or other attendee.

Hosts are solely responsible for their events: safety, security, licensing, permits, taxes, capacity, age and ID checks, the accuracy of listings, honoring tickets, and complying with all applicable laws and venue rules. Hosts agree to indemnify and hold Proximity harmless from any claim arising out of their events or conduct.

Ticket prices and any service fees are shown at checkout. Tickets are issued by the host; refund, transfer, and cancellation policies are set and fulfilled by the host. Proximity may facilitate payments through third-party processors and is not responsible for chargebacks, disputes, or a host's failure to deliver an event.

You agree not to use Proximity to post unlawful, fraudulent, harassing, or infringing content; to misrepresent an event; to resell access in violation of a host's terms; to scrape or abuse the service; or to upload sexually explicit, violent, or otherwise prohibited imagery. We may remove content and suspend or ban accounts that break these rules.

You retain ownership of content you upload, but grant Proximity a non-exclusive, worldwide license to host and display it to operate the service. You represent that you have the rights to everything you upload.

The service is provided “as is” and “as available,”without warranties of any kind, express or implied. Proximity does not warrant that any event will occur, be safe, or meet your expectations, and does not endorse any host, guest, or event.

To the maximum extent permitted by law, Proximity and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, personal injury, or property damage arising from your use of the service or attendance at any event. Our total liability for any claim is limited to the greater of the fees you paid to Proximity in the prior three months or US $100.

You agree to indemnify and hold harmless Proximity from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the service, your events, your content, or your violation of these terms or any law or third-party right.

This section explains what personal data Proximity collects and how we use it. We collect only what we need to run the service, and we don't sell your personal data.

What we collect

• Account & order details: your name, email, phone number, and password (stored only as a salted hash). For ticket buyers we keep this even without an account so we can deliver your ticket.
• Content you submit: party listings, photos, messages, reviews, and reports.
• Payment information: handled by our third-party payment processor. We never see or store full card numbers.
• Usage & device data: basic analytics (pages viewed, approximate area for nearby-party search) to operate and improve the app.

How we use it

• To create and secure your account and verify your email.
• To process orders and deliver tickets, and to email you the exact address when it's released.
• To send service messages (order confirmations, address reveals, host announcements you opted into, and password resets).
• To show parties near you, power host reputation, and keep the platform safe (moderation, fraud and abuse prevention).

Who we share it with

• Hosts receive the limited details needed to run their event (e.g. your name and check-in status). They do not receive your password.
• Service providers who operate the platform on our behalf (payment processing, email delivery, and hosting) under confidentiality obligations.
• Authorities, only where required by law or to protect people's safety.

Your choices

• Texts about your order and address reveals are transactional. You can reply STOP to any message to opt out of further texts.
• You can request a copy of your data or ask us to delete your account by emailing us (below). We keep some records as required for legal, tax, or fraud-prevention reasons.
